These Terms and Conditions (the "Terms") are a legal agreement between you and Authentic Indian, LLC, which runs Authentic Indian Store ("we", "us", "our"). They apply when you visit authenticindianstore.com, create an account, place an order, join our rewards program, or contact us (together, the "Services").
IMPORTANT: SECTION 20 CONTAINS AN AGREEMENT TO RESOLVE DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION AND A WAIVER OF CLASS ACTIONS. IT AFFECTS HOW DISPUTES BETWEEN YOU AND US ARE RESOLVED. YOU MAY OPT OUT OF ARBITRATION WITHIN 30 DAYS, AS EXPLAINED IN SECTION 20.8.
This summary is for convenience only. The full Terms below are what count.
Authentic Indian, LLC is a Wyoming limited liability company with its mailing address at 1030 N Rogers Ln, Ste 121 #5252, Raleigh, NC 27610, United States. You can reach us at •••••••@••••••••••••••••••••.••• or +• ••• •••-••••.
By using the Services, creating an account or placing an order, you agree to these Terms. If you don't agree, please don't use the Services.
These policies also apply to your use of the Services and form part of these Terms: our Shipping Policy, our Refund and Returns Policy, and, if you take part in it, the program terms on our Rewards Program page. If any of them conflicts with these Terms, these Terms control, except that the more specific policy controls on its own subject (for example, shipping times or return windows).
Our Privacy Policy, Cookie Policy and Consumer Health Data Privacy Policy explain how we handle personal information. They are notices to you, not part of this contract.
Most products we sell are made by Indian manufacturers for sale in India and are shipped to you from India. This means that:
Indian law requires packaged goods sold in India to show a "Maximum Retail Price" (MRP) in Indian rupees. The MRP is the highest price at which the product may be sold in India. It is not a US price and does not include the costs of buying the product, exporting it, shipping it internationally or bringing it into the United States. Our prices in US dollars are not conversions of the MRP, and the MRP is not the "regular price" of the product in our store.
We buy products from the brands themselves, their distributors, and established wholesalers and retailers in India. We sell them in the manufacturer's original packaging. We don't open, repackage, relabel or alter products, except where a product page says otherwise.
If you believe a product you received is not genuine, contact us within 30 days of delivery with photos of the product, its packaging and its batch or lot number. We'll investigate, and if we can't confirm that the product is genuine, we'll refund it.
Many products show a manufacturing date and an expiry or "best before" date, sometimes as "best before X months from manufacture". Shelf life varies by product, and we can't guarantee a minimum remaining shelf life unless the product page says so. If an item arrives already past its expiry or best-before date, or within 30 days of it, our Refund and Returns Policy explains how we'll put it right.
All products are subject to availability. We may limit quantities per order, per customer or per household, discontinue products, and change products, descriptions and images at any time. We won't send you a different product as a substitute without your consent.
Your order enters the United States as an import. US Customs and Border Protection, the Food and Drug Administration (FDA) and other agencies may inspect, delay, detain, refuse or destroy shipments. We don't control those decisions. Our Shipping Policy explains what we'll do if a shipment is held or refused.
Please read this section carefully. It explains the limits of the information we give you and the precautions you should take.
Product descriptions, ingredients, benefits, directions and images come from the manufacturers and their Indian marketing materials. We pass them on in good faith but don't independently test products or verify manufacturers' claims. Manufacturers change their products and packaging, so the item you receive may differ from what is shown. The label on the product you receive is the authoritative source. Read it before use, and follow its directions and warnings.
Nothing on our site, in our emails or from our support team is medical, nutritional or other professional advice. Many of our products are Ayurvedic, herbal or traditional products. Traditional use does not mean a product has been shown to be safe or effective for any purpose.
Statements about health or wellness benefits have not been evaluated by the US Food and Drug Administration. Our products are not intended to diagnose, treat, cure or prevent any disease. Don't use them in place of medical care, and don't stop or change a prescribed treatment without talking to your doctor.
Ask a doctor or pharmacist before using a supplement, nutritional, herbal or Ayurvedic product if you are pregnant or nursing, are buying for a child, take any medication, have a medical condition, or are having surgery. Herbal products can interact with medicines.
The FDA has warned that some Ayurvedic products sold online have contained lead, mercury or arsenic. We do not test the products we sell for heavy metals or other contaminants. Read the ingredient list, and talk to your doctor before using Ayurvedic or herbal products, especially for children or during pregnancy.
Do a patch test before first use, and stop using a product if irritation develops. Use products only as directed (for example, for external use only). Hair coloring products, including henna and indigo-based products, can cause allergic reactions. Follow the patch-test instructions and never use them to dye eyelashes or eyebrows.
Indian packaged foods are labeled under Indian rules, which differ from US allergen labeling rules. Products may contain, or be made in facilities that handle, peanuts, tree nuts, milk, eggs, wheat (gluten), soy, sesame, mustard, fish or shellfish, even if the label or our description doesn't say so. If you have a food allergy or intolerance, don't rely only on our description or the label. Contact the manufacturer, or don't buy the product.
We do not sell infant formula. Baby foods, cereals, nutrition drinks and baby care products are not substitutes for breast milk or infant formula. Use them only for the ages and in the way the label states, and ask your pediatrician first. Keep all products out of the reach of children.
Store products as the label directs. Products can be exposed to heat or cold in transit. Some products, such as chocolates, creams and oils, may soften, separate or change texture, which doesn't always mean they are spoiled. If you're unsure whether a product is safe to use, don't use it, and contact us.
If you have a reaction to a product, stop using it and get medical help if needed. Please tell us, so we can let the manufacturer know. You can also report it to the FDA through MedWatch (fda.gov/medwatch).
WARNING: Some products sold on this site can expose you to chemicals, including lead, which are known to the State of California to cause cancer and birth defects or other reproductive harm. For more information, go to www.P65Warnings.ca.gov.
We ship only to addresses in the United States, as described in our Shipping Policy. Delivery dates are estimates, not guarantees.
All purchases from us are made under a shipment contract. Title to the products and the risk of loss pass to you when we hand them to the carrier for shipment to you. This doesn't reduce what we promise in our Shipping Policy and Refund and Returns Policy: we will still help with, replace or refund packages that are lost or damaged in transit as those policies describe.
Cancellations, returns, refunds and problems with an order are covered by our Refund and Returns Policy. Nothing in these Terms limits any rights you have under applicable law that can't be waived.
If you take part in our rewards program, the program terms on our Rewards Program page apply. Points and rewards have no cash value, are not your property, and can't be sold or transferred.
You agree not to:
The Services, including our site design, text, graphics, logos, software and our own photographs, belong to us or our licensors and are protected by intellectual property laws. Product names, brand names, logos and packaging images belong to their owners. We give you a limited, revocable, non-transferable permission to use the Services for your personal shopping. You may not use our content for any commercial purpose without our written permission. We reserve all rights not expressly granted.
If you believe content on our site infringes your copyright, send a notice to our copyright agent at the address in section 27, or by email to •••••••@••••••••••••••••••••.••• with "Copyright notice" in the subject. Include:
We may remove material that is the subject of a valid notice, and we close the accounts of repeat infringers where appropriate.
The Services rely on, and link to, services run by others, such as our payment provider, shipping carriers and analytics providers. Those services have their own terms and privacy policies, and we are not responsible for them. A link to another website does not mean we endorse it.
EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR OUR POLICIES (INCLUDING OUR COMMITMENTS ABOUT DAMAGED, WRONG, EXPIRED, MISSING AND NON-GENUINE ITEMS), AND TO THE FULLEST EXTENT PERMITTED BY LAW:
Any warranty that comes with a product is given by its manufacturer, not by us, and may not apply outside India. Some states do not allow implied warranties to be excluded, so some of these exclusions may not apply to you. Where implied warranties can't be excluded, they are limited to the shortest period the law allows.
TO THE FULLEST EXTENT PERMITTED BY LAW:
Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, gross negligence or willful misconduct, or any other liability that the law does not allow us to limit or exclude. Some states don't allow the exclusion or limitation of incidental or consequential damages, so some of these limits may not apply to you.
To the extent permitted by law, you agree to indemnify and hold harmless Authentic Indian, LLC and its members, managers, employees and agents from third-party claims, and the reasonable costs (including attorneys' fees) of those claims, that arise from your breach of these Terms, your misuse of the Services, or your violation of the law or of someone else's rights.
PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU AND US TO RESOLVE MOST DISPUTES THROUGH BINDING INDIVIDUAL ARBITRATION, RATHER THAN IN COURT BEFORE A JUDGE OR JURY, AND IT WAIVES CLASS ACTIONS.
Most concerns can be solved quickly by contacting our support team. Before either of us starts an arbitration or a court case, the party bringing the claim must send the other a written Notice of Dispute. You send yours to the address in section 27 and by email to •••••••@••••••••••••••••••••.••• with "Notice of Dispute" in the subject. We send ours to the email address on your account or order.
The Notice must include your name, email address, postal address and order number (if any), a description of the dispute, and the relief you want. It must be personally signed by you (and by your lawyer, if you have one). For 60 days after the Notice is received, we will both try in good faith to resolve the dispute. If either of us asks, we will hold an individual call or video meeting, which you will attend personally (with your lawyer, if you have one). Time limits for bringing the claim are paused during this period. Following this process is a condition of starting an arbitration or court case.
You and Authentic Indian, LLC agree that any dispute, claim or controversy between you and us that arises from or relates to these Terms, the Services, any product or order, our advertising or marketing, or our handling of personal information (each a "Claim") will be resolved by binding individual arbitration, and not in court. This applies whatever legal theory the Claim is based on, and whether it arose before or after you agreed to these Terms. There are only these exceptions:
The arbitrator decides all questions about the interpretation, scope, enforceability and formation of this agreement to arbitrate. A court, and not the arbitrator, decides any question about whether sections 20.5 (class action waiver), 20.6 (mass filings) or 20.7 (public injunctive relief) are valid or enforceable, and whether a Claim falls within the small-claims exception.
Except as needed to enforce an award or as required by law, neither of us will disclose the existence, content or result of an arbitration.
YOU AND WE MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL OR REPRESENTATIVE PROCEEDING. The arbitrator may award relief only to the individual party seeking it, and only to the extent needed to resolve that party's individual Claim. Unless we both agree, the arbitrator may not join or consolidate more than one person's Claims, except as section 20.6 allows. If a court decides, after all appeals, that this waiver can't be enforced as to a particular Claim or request for relief, that Claim or request (and only that one) will be removed from arbitration and decided in court, after the individual arbitration of the remaining Claims has finished.
If 25 or more similar demands for arbitration are filed against us, or by us, by or with the help of the same or coordinated law firms or organizations, the AAA's Mass Arbitration Supplementary Rules and fee schedule apply. To the extent those rules allow, the demands may be administered in batches, with one arbitrator and one set of administrative fees for each batch. Each claimant's Claim will still be decided individually. Time limits for each Claim are paused while this process applies.
If either of us asks for public injunctive relief (relief whose main purpose and effect is to prevent unlawful acts that threaten future injury to the general public), that request will be decided by a court and not in arbitration, after the individual Claims have been arbitrated. The court case will be paused until the arbitration has finished.
You may opt out of this agreement to arbitrate within 30 days after you first accept these Terms (for example, by creating an account or placing an order). Send us an email at •••••••@••••••••••••••••••••.••• with "Arbitration opt-out" in the subject, or a letter to the address in section 27. Include your name, postal address and the email address you use with us, and say that you want to opt out of arbitration. Opting out doesn't affect any other part of these Terms, or any earlier agreement to arbitrate that you made with us.
If we change this section 20 after you've accepted it (other than to update our contact details), you may reject the change by writing to us within 30 days after it takes effect. In that case the version of this section that you last accepted continues to apply to you. A change never applies to a Claim that one of us had already notified the other about before the change took effect.
If any part of this section 20 is found to be unenforceable, the rest of it still applies, except as section 20.5 provides. If this agreement to arbitrate is found unenforceable in its entirety, or you opt out, Claims will be decided in the courts described in section 21. This section 20 survives the end of your account and of these Terms.
You may close your account at any time by contacting us. We may suspend or close your account, cancel pending orders, or limit your access to the Services if you breach these Terms, if we suspect fraud or abuse, or if the law requires it. Points earned through fraud or abuse are forfeited. The sections of these Terms that by their nature should continue (including sections 3, 4 and 11 through 25) survive after your account is closed.
We are not responsible for delays or failures caused by events beyond our reasonable control. These include natural disasters, extreme weather, epidemics, war, terrorism, civil unrest, strikes, failures or delays of carriers and postal services, customs inspections and border delays, changes in law, tariffs, import or export restrictions and other government action, power or internet outages, cyberattacks, and failures of our suppliers. If such an event delays your order, we'll let you know, and you may cancel any items that haven't shipped for a full refund.
We may update these Terms from time to time. We'll post the new version on this page with a new "Last updated" date. If a change is material, we'll also tell you by email or on the site before it takes effect. Changes apply only going forward: each order is governed by the Terms in effect when you placed it. If you keep using the Services after a change takes effect, the updated Terms apply to that use. Section 20.9 applies to changes to section 20.
